The website www.beige-habilleur.com is owned by the company Jean et Basile, a simplified joint stock company with a capital of 4,000€ and registered offices located at 68 rue de Bretagne, 61000, Alençon, France. The company Jean et Basile is registered at the Alençon Trade and Companies Register under the number 808 024 319.
Article 1: DEFINITION
The terms used in the following conditions are defined as follows:
- Buyer: The party acquiring products from the website
- Seller: The party making the sale, simplified joint-stock company “Jean et Basile”
- Website: www.beige-habilleur.com
- Products: Items sold on the website including, but not limited to, clothing, accessories, footwear and « made to order ».
ARTICLE 2: APPLICATION AND CHANGES IN THE GENERAL TERMS AND CONDITIONS OF SALE
2.1 The purpose of these General Terms and Conditions of Sale (GTCS) is to define the rights and obligations of the Parties engaged in the online sale of products and services offered by the Seller to the Buyer.
2.2 These general terms and conditions of sale apply solely to all orders placed on our website www.beige-habilleur.com.
2.3 The simplified joint-stock company Jean et Basile reserves the possibility to modify these general conditions of sale at any time. Any modifications will be applied immediately and relevant to any order received at that time and beyond.
2.4 The present general terms and conditions of sale express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation all the provisions of these general terms and conditions of sale. No general or specific condition appearing in the documents sent or handed over by the consumer may be integrated into these general terms and conditions of sale since these documents would be incompatible with these general terms and conditions of sale.
ARTICLE 3: PRODUCTS AND VALIDITY OF THE OFFER
3.1 The products presented by the Seller are available within the limits of available stocks at the time of the order.
3.2 Availability of "Made to order" offers is subject to acceptance of the order by the manufacturer.
3.3 The descriptions and pictures available on the Seller's website are as accurate as possible. However, slight variations may occur without the Seller being held responsible or the validity of the sale being called into question.
3.4 Upon confirmation of the order, the Seller checks the availability of the products in stock. In the event the item ordered is not available, the Seller undertakes to offer an exchange or a refund within 30 days.
ARTICLE 4: PRICES
4.1 The prices indicated are inclusive of all taxes (V.A.T.), excluding the cost of processing and delivery and any customs duties related to delivery.
4.2 The Seller reserves the right to change its prices at any time and undertakes to respect the prices indicated at the time of the order, subject to the availability of the products.
ARTICLE 5: PAYMENT METHODS AND SECURITY
5.1 Payments are made by credit or debit card on the secure and encrypted bank servers of our partner Banque Populaire Rives de Paris. No information concerning your bank account is transmitted via the www.beige-habilleur.com website.
5.2 The Seller reserves the right to refuse to make a delivery or to honour an order from a consumer with whom a dispute is being administered.
5.3 The transfer of ownership from the Seller to the Buyer will only take place once the Seller has received full payment.
5.4 The risks of the delivered goods are transferred to the Buyer as from the reception of the products at the address indicated at the time of the order.
ARTICLE 6: CONFIRMATION OF ORDERS
6.1 The Buyer shall read and adhere unreservedly to the general terms and conditions of sale and their terms prior to confirming the order.
6.2 The Buyer undertakes to provide accurate data and information in good faith in the online forms accessible from the site.
6.3 The Seller reserves the right to contact the Buyer to verify or confirm the information provided. The provision of this information is one of the conditions for the confirmation of the order. The Buyer, therefore, undertakes to provide a valid email address and telephone number when filling in the order form.
6.4 In certain cases, particularly for non-payment, incorrect address or any other problem related to your account, the Seller reserves the right to suspend the order until the problem is resolved.
ARTICLE 7: ORDERS AND DELIVERIES
7.1 Packages are delivered by post or by an independent carrier to the address indicated by the Buyer when ordering.
7.2 Delivery costs are included in the total amount to be paid for your order depending on the option chosen and the amount of the order.
7.3 The Seller undertakes to process orders within 15 days from the day following the confirmation of your order.
7.4 Delivery times are given in working days from the date of departure from our warehouse and are given as an indication. Exceeding this time limit does not entitle you to damages.
7.5 In the event of non-delivery due to the carrier, the Seller undertakes to reship all or part of the order within the limits of these general terms and conditions of sale.
7.6 The Buyer must check the conformity and condition of the items delivered at the time of delivery and before signing the carrier's delivery note. This verification is considered to have been carried out once the Buyer or a person authorised by the Buyer has signed the delivery note.
7.7 If at the time of receipt, the Buyer notices an anomaly on the packaging, that it is torn or damaged, he must check the condition of the products. If the latter are damaged, the Buyer must refuse the delivery and indicate on the delivery note "Package refused because opened or damaged".
7.8 Shipping is free:
- for all orders of €250 or more (incl. tax) delivered to mainland France and European Union countries,
- for all orders of €350 or more (incl. tax) delivered to the rest of the world.
For orders below these amounts, shipping fees are automatically calculated and shown at checkout.
Please note that for all deliveries outside the European Union, customs duties, import taxes or local charges may apply upon arrival. These costs are the sole responsibility of the Buyer.
7.9 The information requested from the Buyer is necessary to process the order and may be communicated to the contractual partners of the company “Jean et Basile” acting within the framework of the execution of this order.
ARTICLE 8: RIGHT OF CANCELLATION AND RETURN
8.1 The Buyer can decide to use his right of cancellation within 14 (fourteen) days from the reception of the order.
8.2 The Buyer must notify the Seller of his/her wish to cancel the order within the given time limit by e-mail to contact@beige-habilleur.com and then fill in the form enclosed within the package.
8.3 Return shipping costs are free of charge worldwide. The Buyer must contact the Seller using the address contact@beige-habilleur.com, we will send you a label to stick on the parcel so that you do not have to advance the costs.
8.4 The return must be made no later than 14 (fourteen) days after sending your cancellation notice.
8.5 The product must be returned in its original packaging with all accessories and labels.
8.6 Returned products must be in perfect condition and complete with original labelling. No stained, damaged, worn, washed or unfit-for-sale products will be accepted. It is advisable to try the products with the utmost care.
8.7 Refunds will be made within 30 (thirty) days of receipt of the returned item(s) by the Buyer.
8.8 Shoes must be tried on a carpet or a rug. Both the shoe and its sole must be in perfect condition to qualify for a return.
8.9 In the event of rejection, the product will be returned to the Buyer at his expense to the address indicated at the time of the order.
8.10 In accordance with Article L121-21-8 of the Consumer Code, the following are excluded from the right of cancellation: periodicals and magazines as well as goods made to the consumer's specifications or clearly personalised. Products in the magazine and "made to order" categories and all products marked "made to order" can therefore not be returned.
ARTICLE 9: INDIVISIBILITY OF THESE GENERAL CONDITIONS OF SALE
9.1 If one or more stipulations of the present general terms and conditions of sale are held to be invalid or declared as such in application of a law, a regulation which would be applicable to them, or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their scope.
ARTICLE 10: JURISDICTION
10.1 These GTC are subject to French law in both substance and form. In the event of a dispute, the Buyer shall, before taking any action, contact the Seller to find an amicable solution.
