PREAMBLE

The website www.beige-habilleur.com is managed by the company Jean et Basile, a simplified joint stock company under French law with a share capital of 4000 euros, whose registered office is located at 68 rue de Bretagne 61000 Alençon (France), registered in the Alençon Trade and Companies Register under number 808 024 319.

 

ARTICLE 1: DEFINITION

The terms used in these general terms and conditions of sale shall have the meaning given to them below:

  • Buyer: natural person acquiring Products through the Site
  • Seller: S.A.S. Jean et Basile
  • Site: www.beige-habilleur.com
  • Products: items offered for sale on the site such as ready-to-wear, accessories, shoes or "made to order".

 

ARTICLE 2: SCOPE OF APPLICATION AND MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

2.1 The purpose of these General Terms and Conditions of Sale (GTC) is to define the rights and obligations of the Parties in connection with the online sale of products and services offered by the Seller to the Buyer.

2.2 These general terms and conditions of sale apply only to all orders placed on our website www.beige-habilleur.com.

2.3 S.A.S. Jean et Basile reserves the right to modify these general terms and conditions of sale. In the event of modification, the general terms and conditions of sale in force on the day of the order will apply to each order.

2.4 These general conditions express the entirety of the parties' obligations. In this sense, the consumer is deemed to accept without reservation all the provisions provided for in these general conditions. No general or specific condition appearing in the documents sent or delivered by the consumer may be incorporated into these, insofar as these documents would be incompatible with these general conditions.

 

ARTICLE 3: PRODUCTS AND VALIDITY OF THE OFFER

3.1 The products presented by the Seller are available within the limits of actual stock at the time of order.

3.2 "Made to order" offers are available subject to acceptance of the order by the manufacturer.

3.3 The descriptions and photographs available on the Seller's site are as precise as possible. Slight variations may however be noted without the Seller's liability being engaged or the validity of the sale being called into question.

3.4 Upon validation of the order, the Seller checks the availability of products in stock. In case of unavailability, the Seller undertakes to propose an exchange or a refund within 30 days.

 

ARTICLE 4: PRICE

4.1 The prices indicated are all taxes included (TTC), excluding participation in processing and shipping costs.

4.2 The Seller reserves the right to modify its prices at any time and undertakes to respect the prices indicated at the time of the order, subject to the availability of products.

 

ARTICLE 5: PAYMENT TERMS AND SECURITY

5.1 Payments are made by credit card on the secure and encrypted banking servers of our partner Banque Populaire Rives de Paris. No information concerning your bank account transits via the website www.beige-habilleur.com

5.2 The Seller reserves the right to refuse to make a delivery or to honor an order from a consumer with whom a dispute is ongoing.

5.3 The transfer of ownership from the Seller to the Buyer will only take place once the full payment has been collected by the Seller.

5.4 The risks of the delivered goods are transferred to the Buyer upon receipt of the products at the address indicated during the order.

 

ARTICLE 6: ORDER VALIDATION

6.1 The Buyer reads and unreservedly adheres to the general conditions of sale and their terms prior to the validation of the order.

6.2 The Buyer undertakes to provide accurate and good faith data and information in the online forms accessible from the site.

6.3 The Seller reserves the right to contact the Buyer to verify or confirm the information provided. The provision of this information is one of the conditions for validating the order. The Buyer therefore undertakes to provide a valid email address and telephone number when completing the order form.

6.4 In certain cases, particularly for non-payment, incorrect address or any other problem related to your account, the Seller reserves the right to suspend the order until the problem is resolved.

 

ARTICLE 7: ORDERS AND DELIVERIES

7.1 Packages are delivered by post or by an independent carrier to the address indicated by the Buyer when ordering.

7.2 Delivery costs are included in the total amount to be paid for your order depending on the option chosen and the amount of the order.

7.3 The Seller undertakes to process orders within 15 days from the day following the validation of your order.

7.4 Delivery times are expressed in working days from the date of leaving our warehouses, indicated as an estimate. An exceeding of this period does not give rise to damages.

7.5 In case of delivery failure due to the carrier, the Seller undertakes to reship all or part of the order within the limits of these general terms and conditions of sale.

7.6 The Buyer must check the conformity and condition of the items delivered at the time of delivery and before signing the carrier's delivery note. This verification is considered to have been carried out once the buyer or a person authorized by the latter has signed the order form.

7.7 If, upon receipt, the Buyer notices an anomaly on the packaging, that it is torn or damaged, they must check the condition of the products. If they are damaged, the Buyer must refuse delivery and indicate on the slip "Package refused as opened or damaged".

7.8 Shipping costs are free:

  • for any order equal to or greater than €350 incl. VAT for metropolitan France and European Union countries,
  • for any order equal to or greater than €500 incl. VAT for the rest of the world.

Below these thresholds, shipping costs are automatically calculated and displayed during order validation.

For deliveries outside the European Union, customs duties and import taxes are the responsibility of the Buyer and paid in the destination country upon delivery (DAP — Delivered At Place). The Seller does not cover these costs.


7.9 The information requested from the consumer is necessary for the processing of their order and may be communicated to the contractual partners of Jean et Basile involved in the execution of this order.

 

ARTICLE 8: RIGHT OF WITHDRAWAL AND RETURN

8.1 The Buyer may decide to exercise their right of withdrawal within 14 days from the receipt of the order.

8.2 The Buyer must notify their wish to withdraw to the Seller within the allotted time by e-mail to contact@beige-habilleur.com and then fill out the form attached to the package.

8.3 To initiate a return, the Buyer contacts the Seller at contact@beige-habilleur.com.

Full-price items: return costs are free from €350 for the European Union and from €500 for the rest of the world. Below these thresholds, they are at the Buyer's expense.

Sale and outlet items: return costs are always at the Buyer's expense, regardless of the order amount. The return is made under the Buyer's sole responsibility until effective receipt by the Seller. In case of loss or non-delivery, the Buyer turns directly against the carrier.

8.4 The return must be made no later than 14 days following the sending of your withdrawal notification.

8.5 The product must be returned in its original packaging with all accessories and labels.

8.6 Returned products must be in perfect condition. No stained, deteriorated, worn, washed or unsuitable for sale product will be accepted. It is advisable to try on products with the greatest care.

8.7 The refund will be made within 14 days following the receipt of the returned products by the Buyer.

8.8 Shoes must imperatively be tried on a carpet or rug. The shoe and its sole must be in new condition to be eligible for a return.

8.9 In case of rejection, the product will be reshipped to the Buyer at their expense to the address indicated during the order.

8.10 In accordance with article L121-21-8 of the Consumer Code, the right of withdrawal does not apply to: periodicals and magazines as well as goods made according to the consumer's specifications or clearly personalized. Products from the magazine, "made to order" categories and all products marked "made to order" cannot therefore be returned.

8.11 Orders shipped outside the European Union are delivered under DAP (Delivered At Place) terms. Customs duties, import taxes, and any administrative fees applicable in the destination country are the Buyer's sole responsibility and must be settled directly with the relevant local authorities.

In the event of a return, refunds cover the product price only. Customs duties and import taxes paid by the Buyer in the destination country are non-refundable by the Seller, as they are collected independently by local customs authorities.

 

ARTICLE 9: INDIVISIBILITY OF THESE GENERAL TERMS AND CONDITIONS OF SALE

9.1 If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, a regulation applicable to them, or following a final decision of a competent court, the other stipulations will retain all their force and scope.

 

ARTICLE 10: JURISDICTION

10.1 These GTC are subject to French law for both substantive and formal rules. In the event of a dispute, the Buyer will, before any action taken, contact the Seller in order to find an amicable solution.
