ARTICLE 1: DEFINITIONS

The terms used in these General Terms and Conditions of Sale shall have the meaning given to them below:

  • Buyer: a natural person purchasing Products through the Site.
  • Seller: S.A.S. Jean et Basile.
  • Site: www.beige-habilleur.com
  • Products: items offered for sale on the Site, such as ready-to-wear, accessories, footwear or “Made to Order” items.

ARTICLE 2: SCOPE AND AMENDMENT OF THE GENERAL TERMS AND CONDITIONS OF SALE

2.1 The purpose of these General Terms and Conditions of Sale (GTCS) is to define the rights and obligations of the Parties in connection with the online sale of products and services offered by the Seller to the Buyer.

2.2 These General Terms and Conditions of Sale apply exclusively to orders placed on our website www.beige-habilleur.com.

2.3 S.A.S. Jean et Basile reserves the right to amend these General Terms and Conditions of Sale. In the event of an amendment, each order shall be governed by the General Terms and Conditions of Sale in force on the day the order is placed.

2.4 These General Terms and Conditions express the entirety of the obligations of the Parties. Accordingly, the consumer is deemed to accept without reservation all the provisions set out in these General Terms and Conditions. No general or specific condition appearing in documents sent or delivered by the consumer shall be incorporated into these terms where such documents are incompatible with these General Terms and Conditions.

ARTICLE 3: PRODUCTS AND VALIDITY OF THE OFFER

3.1 The products presented by the Seller are available within the limits of stock at the time of the order.

3.2 “Made to Order” offers are subject to acceptance of the order by the manufacturer.

3.3 The descriptions and photographs on the Seller’s Site are as accurate as possible. Slight variations may, however, occur without engaging the Seller’s liability or affecting the validity of the sale.

3.4 Upon validation of the order, the Seller checks the availability of the products. If a product is unavailable, the Seller informs the Buyer and refunds the sums paid without delay, or offers an exchange if the Buyer wishes.

ARTICLE 4: PRICES

4.1 Prices are shown inclusive of all taxes (VAT included), excluding processing and shipping costs.

4.2 The Seller reserves the right to change its prices at any time and undertakes to apply the prices shown at the time of the order, subject to product availability.

ARTICLE 5: PAYMENT AND SECURITY

5.1 Payments are made by bank card, PayPal, Apple Pay, Google Pay or Klarna, via the secure servers of our payment providers, including Banque Populaire Rives de Paris. No banking information is stored by the Seller.

5.2 The Seller reserves the right to refuse a delivery or an order from a consumer with whom a dispute is ongoing.

5.3 Ownership passes from the Seller to the Buyer only once full payment has been received by the Seller.

5.4 Risk in the delivered goods passes to the Buyer upon physical possession of the products at the address given when placing the order.

ARTICLE 6: ORDER VALIDATION

6.1 The Buyer reads and agrees without reservation to the General Terms and Conditions of Sale before validating the order.

6.2 The Buyer undertakes to provide accurate information in good faith in the online forms available on the Site.

6.3 The Seller reserves the right to contact the Buyer to check or confirm the information provided. Providing this information is one of the conditions for validating the order. The Buyer therefore undertakes to provide a valid email address and telephone number when completing the order form.

6.4 In certain cases, in particular non-payment, an incorrect address or any other issue with the account, the Seller reserves the right to suspend the order until the issue is resolved.

ARTICLE 7: ORDERS AND DELIVERY

7.1 Parcels are delivered by post or by an independent carrier to the address given by the Buyer when placing the order.

7.2 Shipping costs are included in the total amount payable, depending on the option selected and the order amount.

7.3 Orders are prepared within 1 to 3 working days of validation. In accordance with Article L216-1 of the French Consumer Code, delivery takes place no later than 30 days after the conclusion of the contract.

7.4 Delivery times are expressed in working days from dispatch from our warehouses and are given for guidance only. Exceeding these times does not give rise to damages.

7.5 If a delivery fails due to the carrier, the Seller undertakes to reship all or part of the order within the limits of these General Terms and Conditions of Sale.

7.6 The Buyer must check the conformity and condition of the items delivered at the time of delivery and before signing the carrier’s delivery note. This check is deemed to have been carried out once the Buyer, or a person authorised by the Buyer, has signed the delivery note.

7.7 If, upon receipt, the Buyer notices that the packaging is torn or damaged, they must check the condition of the products. If the products are damaged, the Buyer must refuse the delivery and write on the delivery slip: “Parcel refused, opened or damaged”.

7.8 Shipping is complimentary:

  • for any order of €350 or more (incl. VAT) to Metropolitan France and European Union countries;
  • for any order of €500 or more (incl. VAT) to the rest of the world.

Below these thresholds, shipping costs are calculated automatically and shown at checkout.

For orders delivered outside the European Union, customs duties, import taxes and any local fees may be payable on arrival of the parcel and remain the sole responsibility of the Buyer (DAP, Delivered At Place). The Seller does not cover these charges.

7.9 The information requested from the consumer is necessary to process the order and may be shared with the contractual partners of Jean et Basile involved in fulfilling the order.

ARTICLE 8: RIGHT OF WITHDRAWAL, RETURNS AND EXCHANGES

8.1 The Buyer has 14 days from receipt of the order to exercise their right of withdrawal, without giving any reason.

8.2 The Buyer notifies their withdrawal within this period by email to contact@beige-habilleur.com, stating their name, order number and the items concerned.

8.3 Return costs:

  • Full-price items: returns are complimentary for orders of €350 or more within the European Union and €500 or more in the rest of the world. Above these thresholds, a prepaid label is sent by email. Below them, return costs are paid by the Buyer.
  • Sale and outlet items: return costs are always paid by the Buyer, whatever the order amount.

In all cases, the return is the Buyer’s responsibility until it is received by the Seller.

8.4 The return must be sent no later than 14 days after the withdrawal notification.

8.5 The product must be returned in its original packaging, with all accessories and tags.

8.6 Products must be returned in their original condition: unworn, unwashed and fit for resale. We advise trying products on with the greatest care. In accordance with Article L221-23 of the French Consumer Code, the Buyer may be held liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the product. The refund may then be reduced accordingly.

8.7 The Seller refunds all sums paid, including the initial standard delivery costs, no later than 14 days after receiving the withdrawal notification. The Seller may withhold the refund until the products have been received back or until the Buyer has provided proof of dispatch. Additional costs for express delivery are not refunded. The refund is made using the payment method used for the order.

8.8 Shoes must be tried on a rug or carpet only. The shoe and its sole must be in new condition.

8.9 Exchanges: exchanges are possible within the same 14-day period, for the same model in another size or colour, subject to availability. For a different model, the Buyer requests a refund and places a new order. Return costs for the item being exchanged follow the rules of Article 8.3. Shipping of the new item is complimentary. If the requested size or colour is no longer available, the Buyer is refunded under the conditions of Article 8.7.

8.10 In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to periodicals and magazines, or to goods made to the consumer’s specifications or clearly personalised. Magazines and products marked “Made to Order” therefore cannot be returned. If they are returned, they will be sent back to the Buyer at the Buyer’s expense.

8.11 Orders shipped outside the European Union are delivered under DAP (Delivered At Place) terms. Customs duties, import taxes and any administrative fees in the destination country are the sole responsibility of the Buyer. In the event of a return, the refund covers the price of the products only: these duties and taxes, collected by the local customs authorities, are not refundable by the Seller.

ARTICLE 9: SEVERABILITY

9.1 If one or more provisions of these General Terms and Conditions of Sale are held invalid or declared as such under a law or regulation, or following a final decision of a competent court, the remaining provisions shall retain their full force and effect.

ARTICLE 10: GOVERNING LAW AND JURISDICTION

10.1 These GTCS are governed by French law, both as to substance and form. In the event of a dispute, the Buyer shall first contact the Seller in order to seek an amicable solution.
